NSW trainer disqualified for four months

Racing NSW Stewards on Thursday conducted the hearing of charges issued against licensed trainer Mr Clint Lundholm in respect an inquiry opened at the Rosehill Gardens race meeting on 30 May 2020. Mr Lundholm was charged in the following terms.

1. Charge 1 AR232(i) – False Evidence

The details of the charge being that Mr Lundholm did give evidence at a Stewards inquiry conducted at the Rosehill Gardens race meeting on Saturday 30 May 2020 in respect to his possession of oral syringes in a float used to transport Sticks ‘n’ Stones, Kahlo and Joey’s Destiny to the race meeting in the knowledge such evidence was false.

Plea: Guilty

2. Charge 2 – AR251(1) Possession of syringes on course

The details of the charge being that Mr Lundholm did have in his possession in a horse float located on Rosehill Gardens racecourse and used to transport Sticks ‘n’ Stones, Kahlo and Joey’s Destiny to compete at the Rosehill Gardens race meeting on Saturday 30 May 2020, 3 x BCAA Paste oral syringes such syringes that could be used to administer a prohibited substance.

Plea: Guilty

Further evidence was taken from Mr Lundholm who appeared by video conference.

Penalty

In considering an appropriate penalty the Stewards took into account the following matters
1. Character references provided for Mr Lundholm.
2. His submissions received by Stewards on 21 June 2020.
3. His current professional and personal circumstances.
4. His good standing in the industry and good record having been licensed in the thoroughbred industry for approximately 15 years.
5. Seriousness of the offence and circumstances upon which the breach was committed.

Charge 1 AR232(i) – having regard to precedent penalties and the principles associated with a breach of this rule, the Stewards have determined the starting point for this breach is a period of 6 months disqualification. Having regard to Mr Lundholm’s guilty plea and co-operation with the Stewards after admitting the offence, the Stewards have determined the appropriate penalty is that he be disqualified for a period of 4 months to commence on 9 July 2020 and to expire on 9 November 2020.

In accordance with the provisions of AR283(7) & (8) the commencement of the disqualification was deferred for a period of 7 days, however during this period Mr Lundholm is not to start a horse in a race.

Charge 2 AR251(1) – having regard to precedent penalties a fine of $500 was imposed.

Relevant Rules
AR 232 Failure to observe processes and directions of PRAs or Stewards
A person must not:
(i) give any evidence at an interview, investigation, inquiry, hearing and/or appeal which is false or misleading.
AR 251 Possession of a prohibited substance/equipment at race meeting
(1) A person must not, without the written permission of the Stewards, have in his or her possession:
(a) on a racecourse where a race meeting is being conducted; or
(b) in any motor vehicle, horse float or other mode of transport used for the purpose of transporting a horse/s to and/or from a race meeting,
any prohibited substance, or a syringe, needle, naso-gastric tube or other instrument that could be used:
(i) to administer a prohibited substance to a horse; or
(ii) to produce a prohibited substance in a horse.
