NSW trainer suspended for four months 11 Oct 2007

Racing NSW Stewards on Thursday conducted an inquiry into the analyst's finding of the prohibited substance Oxazepam in the urine sample taken from Geiger Spirit subsequent to that horse's second placing in the Campbelltown Catholic Club Handicap of 1300m at Kembla Grange Racecourse on Saturday, 4th August 2007.
 
Oxazepam is a human schedule 4 prescription medicine, being a benzodiazepine class of drug used as an anti-anxiety agent. There are no veterinary/chemicals containing Oxazepam registered in Australia.
 
Evidence was today taken from Mr Michael Tubman, part owner-trainer of Geiger Spirit, Mr Domenic Lovalle, part owner of Geiger Spirit (by teleconference), and Mr James Gallacher, stablehand. 
 
Evidence was also taken from Mr Alan Reardon, Senior RNSW Steward, and Mr Bob Nicholson, RNSW Racecourse Detective, who inspected Mr Tubman's Kembla Grange training establishment on 15 September 2007. Mr A Vadaz, Acting Director of the Australian Racing Forensic Laboratory, and Dr Craig Suann, Senior Official RNSW Veterinarian, assisted the inquiry.
 
Mr Tubman pleaded guilty to a charge under AR178 of having brought a horse to the racecourse to engage in a race whereby a prohibited substance had been found in the sample taken from such horse.
 
In issuing a penalty of a four month suspension of licence, Stewards took into account Mr Tubman's good record over a period of 18 years as trainer, his guilty plea and his co-operation during the inquiry. 
 
Mr Tubman was advised that the horses trained by him would have to be shifted as soon as current restrictions allow to the care of a trainer approved by Racing NSW and in the meantime are not to be trained on club premises.
 
Under the powers of AR177 Geiger Spirit was disqualified from its second placing in the Campbelltown Catholic Club Handicap and the placings for that race now read as follows:
 
1st - Abstandance, 
2nd - My Middi, 
3rd - Clean Heels, 
4th - Altomic, 
5th - Our Master Blaster.
