Penalty varied for NSW trainer 29 May 2007

NSW licensed Trainer David Blundell, of Gundagai, on Tuesdya had his appeal against the severity of a penalty incurred upheld by the NSW Appeal Panel.

Mr Blundell had appealed to the Racing NSW Appeal Panel, comprising Principal Member - Mr John Hiatt, and Panel members Messrs John Fletcher and Dominic Beirne against a six month suspension imposed by Racing NSW Stewards.

Mr Blundell was appealing on penalty only, as he had pleaded guilty before the Stewards to a charge under AR178. which states:

When any horse that has been brought to a racecourse for the purpose of engaging in a race and a prohibited substance is detected in any sample taken from it prior to or following its running in any race, the trainer and any other person who was in charge of such horse at any relevant time may be punished.

RNSW Stewards had inquired into the Analyst's finding of the presence of the prohibited substance Butorphanol in the urine sample taken from Miss Johann prior to its fifth placing in the Tumut Cup on Saturday, 20th January 2007. Under the powers of AR177 Miss Johann was disqualified from its 5th placing.

After taking into consideration the specific circumstances of the case, and in particular the hardship placed on Mr Blundell and his family by the six-month suspension, the Panel decided to vary the penalty to a period of three months suspension effective today (Tuesday, 29th May 2007). In addition, the Panel imposed a fine of $2000.
